Draft lease: Cannery wells 3, 4 and 7

DRAFT – NOT FOR DISTRIBUTION. Lease of Groundwater Production Facilities, Alder County, Oregon, and Cold Fork Springs LLC. Dated September 14, 2026.

Section 2. Premises. The County leases to the Lessee municipal wells 3, 4 and 7 at the former Alder Valley Cannery site, together with the pump house and the access road from County Road 12.

Section 4. Term. Twenty (20) years from the effective date, with two renewal options of ten (10) years each at the Lessee’s election.

Section 5. Rent. The Lessee shall pay $0.004 per gallon withdrawn, metered monthly, with a minimum annual payment of $38,000.

Section 9. Curtailment. In a declared drought the County may reduce withdrawals by no more than fifteen (15) percent.
